1. Acceptance of Terms
By creating an account or using Custom Agents (“Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service. These Terms apply to all users, including visitors, registered users, and paying customers.
2. Description of Service
Custom Agents is an AI-powered email automation platform that allows users to create, configure, and deploy AI agents to handle inbound and outbound email communications. The Service includes agent management, inbox routing, response drafting, and team collaboration tools.
3. Account Registration
You must provide accurate, current, and complete information when creating an account. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorized use of your account.
You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you meet this requirement.
4. Acceptable Use
You agree not to use the Service to:
- Send spam, unsolicited emails, or bulk commercial messages
- Harass, abuse, threaten, or harm any individual or group
- Violate any applicable laws or regulations, including those governing email communications (CAN-SPAM, GDPR, CASL)
- Distribute malware, phishing content, or other malicious material
- Impersonate any person or entity or misrepresent your affiliation
- Attempt to gain unauthorized access to our systems or other users' data
- Reverse engineer, decompile, or disassemble any part of the Service
5. AI-Generated Content
The Service uses artificial intelligence to generate email responses and other content on your behalf. You are solely responsible for reviewing, approving, and taking responsibility for all content sent through your agents. Custom Agents does not guarantee the accuracy, appropriateness, or completeness of AI-generated content.
You retain full ownership of all content you input into the Service and all output generated through your account.
6. Billing and Payments
Certain features of the Service require a paid subscription. All fees are stated in US dollars and are non-refundable except as required by law. We reserve the right to change pricing with 30 days' notice. Failure to pay may result in suspension or termination of your account.
7. Data and Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of your information as described therein.
8. Intellectual Property
The Service, including its software, design, logos, and documentation, is owned by Custom Agents and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for your internal business purposes.
9. Termination
We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason at our sole discretion. You may terminate your account at any time from the account settings page. Upon termination, your data may be deleted after a reasonable retention period.
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CUSTOM AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNTS PAID BY YOU IN THE TWELVE MONTHS PRECEDING THE CLAIM.
12. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes via email or a prominent notice within the Service. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.
